Review of closure and relinquishment law in Australia, Canada and South Africa, with four mechanisms for reaching agreement compared. For closure planners and regulators.

What this report found

Relinquishment criteria follow from the agreed post-mining land use. The land use is the goal and the criteria measure whether it has been reached. The guideline sets out a framework for approving those criteria at each mining phase, from the initial environmental management plan through to decommissioning, and compares South African practice with Australian, Canadian and international guidance.

Description

The aim of this project is to provide guidance on the best mechanism for reaching
agreed relinquishment criteria for mine closure in South Africa. Per definition,
“Relinquishment (transition of ownership and responsibility for the land to a third party)” is
often discussed in the context of post-closure land use.

It updates guidance first issued in 1981 and revised in 2007, reflecting later changes to South African rehabilitation legislation.

What this report found

Mapping abandoned, inaccessible bord and pillar workings comes down to two options: borehole deployed laser or sonar scanning, or sensors carried in by unmanned vehicles. Drone mounted laser scanning for air filled voids and sonar carried by small submersibles for flooded workings were judged the most promising, but intrinsic safety, deployment and the risk of losing equipment still favour borehole methods for occasional use.
